Terms of Service

These terms cover what you get when you buy an AusiGen Wellness programme, what we expect from you, and where each side's responsibility ends. They are written to be read, not to be impenetrable. If something here does not sit right with you, do not buy.

1. Agreement to these terms

By using ausigenwellness.com or purchasing a programme through our store at www.ausigen.com, you agree to these Terms of Service ("Terms"). In these Terms, "we", "us" and "our" mean AusiGen Wellness, and "you" or "customer" means you.

These Terms should be read alongside our Privacy Policy and Refund Policy, which form part of your agreement with us.

2. What we provide

AusiGen Wellness sells structured, coach-designed fitness programmes: strength, conditioning, mobility and general nutrition guidance, delivered as written training blocks with session detail, loading guidance and video demonstrations.

To be clear about what this is not:

  • We are not a gym. There is no physical location, no timetable, no drop-in pass, and no equipment provided.
  • We do not supervise your training in person or watch you lift.
  • We are not a healthcare provider and we do not diagnose, treat or manage any condition.
  • Nutrition guidance is general education, not an individual dietary prescription.

Programme content, structure and delivery may change as we improve it. We will not reduce what you have already bought.

3. Eligibility

You must be at least 18 years old to buy from us, and you must be legally able to enter a contract. By ordering, you confirm both.

4. Your order and your details

  • Give us accurate details at checkout — particularly your email address, since that is where your payment link, your receipt and your programme are sent.
  • You are responsible for keeping access to that inbox, and for anything done by someone you forward your programme link to.
  • Tell us promptly at support@ausigenwellness.com if you think an order was placed in your name without your knowledge.

5. Programme access and licence

When you have paid for a programme, we grant you a personal, limited, non-exclusive, non-transferable licence to use that programme content for your own training.

You may not:

  • Share, resell, sublicense, publish or distribute programme content
  • Pass your programme on to anyone else, including training partners
  • Copy programmes into your own coaching business or deliver them to clients
  • Reproduce our written programming, videos or templates in any commercial material
  • Scrape, bulk-download or reverse engineer the site or its content

You are welcome to print or save your own sessions for your own use in the gym. That is the point of them.

6. Prices and payment

  • Prices are in Australian Dollars and include GST where it applies.
  • Programmes are sold as one-off purchases through our store at www.ausigen.com. There is no subscription, no recurring charge and no minimum term.
  • After you place an order we email you a secure payment link. Opening it takes you to a payment page hosted by Stripe.
  • We do not store your card and we cannot charge you again. Each payment is one you actively make on Stripe's page. Nothing is deducted automatically, ever.
  • Payment is due within 7 days of the order unless we agree otherwise in writing. The link in your email stays valid until the order is paid.
  • Your programme is delivered once payment clears.
  • If a price is listed in error, we will tell you before taking payment and you can withdraw the order.

Refunds are governed by our Refund Policy, which preserves your rights under the Australian Consumer Law.

7. Health and safety — read this one properly

Our programmes are general fitness guidance. They are not medical advice, diagnosis or treatment, and they are not a substitute for advice from a doctor or other qualified health professional who knows your history.

We do not screen you. We do not ask for your medical history and we do not assess whether a programme is safe for your particular body. That judgement is yours, and your doctor's.

Consult your doctor before starting this or any exercise programme, particularly if you are pregnant, recovering from injury or surgery, managing a cardiovascular, metabolic, respiratory or musculoskeletal condition, taking medication that affects exercise, over 45 and currently inactive, or unsure for any reason at all.

Exercise carries inherent risk, including muscle strain, joint injury, aggravation of an existing condition and, in rare cases, serious harm. By using our programmes you accept that risk and agree that you train at your own discretion. You agree to:

  • Stop immediately and seek medical attention if you experience chest pain, dizziness, faintness, unusual shortness of breath, or sharp or unfamiliar pain
  • Work within your own capability, scale loads sensibly, and skip any movement that does not feel right
  • Use equipment appropriately and train in a safe environment with adequate space
  • Follow any restriction your own doctor has placed on you, ahead of anything in a programme

We do not guarantee results. Strength, body composition and fitness outcomes depend on training consistency, sleep, nutrition, stress, genetics and starting point. Anyone promising you a fixed outcome in a fixed time is guessing.

8. Acceptable use

You agree not to:

  • Use the site or programmes for any unlawful purpose
  • Attempt to gain unauthorised access to systems or data
  • Interfere with, overload or disrupt the site
  • Upload malicious code, or send content that is abusive, defamatory or infringing
  • Harass or abuse our coaches or support staff
  • Misrepresent yourself, or use a false identity to obtain a programme
  • Use our content or brand to imply endorsement, affiliation or accreditation that does not exist

We may refuse or cancel an order that breaches these Terms. Where a breach is serious — fraud, resale of programme content, abuse of staff — we may withdraw access to purchased content without refund.

9. Intellectual property

All programme content, session structures, written coaching material, video, text, graphics, layout, code and the AusiGen Wellness name and logo are owned by us or licensed to us and are protected by Australian and international copyright and trade mark law.

Your purchase buys access, not ownership. No intellectual property transfers to you. Any use beyond the licence in clause 5 requires our written permission.

10. Your content

You keep ownership of what you send us — questions, feedback and any material you attach to an email. You grant us a licence to store and use that material for the purpose of answering you and improving our service.

We will only publish a testimonial or a result of yours with your express permission, and you can withdraw that permission at any time.

11. Third-party services

We rely on third parties to operate: Stripe for payments, our WooCommerce store at www.ausigen.com for orders, and email and hosting providers for delivery and infrastructure. Their own terms apply to their services, and we are not liable for outages or acts outside our control.

12. Availability

We aim to keep the site available continuously, but we do not warrant uninterrupted access. Maintenance, updates, provider outages and events beyond our reasonable control may interrupt service. If an outage prevents you receiving content you have paid for, contact us and we will make it available another way.

13. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. This includes any liability for death or personal injury caused by our negligence.

Subject to that, and to the maximum extent permitted by law:

  • Our services and content are provided on an "as is" basis, and we do not warrant that they will meet every individual requirement or produce a particular result.
  • We are not liable for indirect, incidental, special or consequential loss, including loss of profits, opportunity or data.
  • We are not liable for injury or loss arising from a health condition you did not seek advice about, your failure to follow medical advice, your use of unsafe equipment or environment, or your decision to train beyond your capability.
  • Where liability can be limited, our total liability for any claim is limited, at our option, to resupplying the programme or refunding the amount you paid us for the order giving rise to the claim.

14. Indemnity

You agree to indemnify us against claims, losses and costs arising from your breach of these Terms or your misuse of programme content — except to the extent the loss was caused by us.

15. Withdrawal of access

We may refuse future orders or withdraw access to content if you breach these Terms, or if we discontinue a programme — in which case we will give you reasonable notice and refund anything you have paid for and not received.

Clauses covering intellectual property, limitation of liability, indemnity and governing law survive any withdrawal of access.

16. Changes to these terms

We may update these Terms. The current version lives on this page with its revision date at the top. The version in force when you place an order governs that order.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

18. General

  • If any provision is found unenforceable, the rest continues to apply.
  • Our failure to enforce a provision is not a waiver of it.
  • These Terms, with the Privacy Policy and Refund Policy, are the entire agreement between us.
  • You may not assign your rights under these Terms without our consent.
